Welcome to Rigid Software. By downloading, installing, accessing, or using our software and applications ("Software"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Software.
1. Acknowledgement & Relationship with Apple
These Terms are concluded solely between you and Rigid Software, and not with Apple Inc. ("Apple"). Rigid Software, not Apple, is solely responsible for the Software and the content thereof.
You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Software.
2. License Grant
Rigid Software grants you a limited, non-exclusive, non-transferable, revocable license to use the Software on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
3. Acceptable Use & Restrictions
You agree to use the Software only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations.
You may not:
- Reverse engineer, decompile, disassemble, modify, or redistribute the Software, except as expressly permitted by applicable law.
- Attempt to bypass, disable, or circumvent any security mechanisms, digital rights management (DRM), or licensing systems within the Software.
- Use the Software in any manner that could damage, disable, overburden, or impair the Software, our services, or interfere with any other party's use of the Software.
4. User Data, Local Storage, and Backups
The Software is designed to prioritize local data storage. Most business, inventory, product, sales, customer, and reporting data is stored directly on your device or within your private iCloud account.
Your Responsibility: You are solely responsible for the accuracy, management, maintenance, security, and backup of your data.
Users are responsible for maintaining backups of their data.
Backup Recommendation: We strongly recommend maintaining regular, independent backups of all business, operational, and financial information stored within the Software.
No Liability for Data Loss: Rigid Software shall not be held responsible or liable for any loss, corruption, damage, or unavailability of data resulting from hardware failure, software failure, user actions or omissions, operating system upgrades or issues, third-party services, iCloud synchronization issues, CloudKit synchronization issues, or any circumstances beyond our reasonable control.
5. Fees, Subscriptions, and In-App Purchases
Certain features or versions of the Software may require paid subscriptions or in-app purchases.
Billing and Payments: All purchases, subscriptions, and billing transactions are processed through Apple's App Store infrastructure and are subject to Apple's terms, policies, and billing procedures.
Refunds: Requests for refunds or payment disputes must be directed to Apple through the App Store. Rigid Software does not directly process payments and cannot issue refunds for App Store transactions.
6. Cloud Services and Third-Party Dependencies
Certain features of the Software rely on Apple services and infrastructure, including Apple WeatherKit, iCloud, and CloudKit.
The availability, speed, reliability, and performance of these services depend on Apple's infrastructure, network connectivity, and other factors outside our control.
Rigid Software is not responsible for service interruptions, synchronization failures, delayed updates, or temporary unavailability caused by third-party platforms or network providers.
7. System Requirements and Performance
Software performance may vary depending on device hardware, operating system version, available storage, memory capacity, data volume, and concurrent software running on your device.
Rigid Software is not responsible for performance degradation, application crashes, delayed operations, or latency resulting from insufficient system resources, unsupported device modifications, excessive data volumes, corrupted databases, or circumstances beyond our reasonable control.
8. No Warranty ("As Is")
The Software is provided on an "as is" and "as available" basis without warranties of any kind.
To the maximum extent permitted by applicable law, Rigid Software disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, availability, reliability, and non-infringement.
We do not warrant that the Software will be uninterrupted, error-free, completely secure, or suitable for every business or legal requirement.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Rigid Software, its owners, developers, affiliates, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages.
This includes, without limitation:
- Loss of profits
- Loss of revenue
- Loss of business opportunities
- Loss of data
- Business interruption
- Financial losses
- Loss of goodwill
arising from or relating to the use of, inability to use, or performance of the Software, even if advised of the possibility of such damages.
10. Intellectual Property
All rights, titles, and interests in and to the Software, including but not limited to source code, user interfaces, graphics, designs, trademarks, logos, documentation, and related intellectual property, remain the exclusive property of Rigid Software and its licensors.
11. Termination
These Terms remain effective until terminated by either you or us.
You may terminate these Terms at any time by removing the Software from all of your devices.
We reserve the right to suspend or terminate access to the Software immediately, without prior notice, if you violate these Terms.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Rigid Software is legally established, without regard to conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively before the competent courts of that jurisdiction.
